Marriages that have degraded to the point of violence and other serious problems should usually be terminated before the situation gets even worse. If a couple initially decides to divorce and then reconciles, there is still the potential for serious issues later on.

A couple in the Fort Lauderdale area experienced turbulence after they had initially filed for divorce. These tensions eventually culminated into domestic violence.

Police detective beats wife after their divorce file is withdrawn

The husband in this couple and suspect is a detective with the Plantation police department, which is just outside of Fort Lauderdale. Court records show that the couple had initially filed for divorce in 2017, but the wife changed her mind and never formally completed the process to end the marriage.

Police had arrived at the couple’s home in Coral Springs to find a woman with a swollen face and scratch marks near her eyes and around her upper body. The suspect was accused of beating the victim by her 13 year old son, which prompted an emergency call and the investigation. The suspect had first tried to blame the victim’s elderly father for beating her, but police believed based on that man’s age and appearance that he probably was not responsible for the beating. The victim informed police that the beating stemmed from an earlier incident where they went out together at night and she refused to have sex with the suspect when they returned home. She said that after her husband struck her several times, he also physically restrained her and attempted to stop her from calling the police.

Police took statements from the entire family and photographs of the victim’s injuries. The suspect was charged with domestic battery and ordered to stay away from their home by a judge after bonding out of Broward County Jail. He was also placed on administrative leave by the Plantation police after working there since 2010 without issue.

Getting divorced before a marriage is too far gone

When it seems that a marriage cannot be fixed due to serious problems, it is best to contact an experienced attorney and arrange to formally divorce. Domestic abuse, theft, adultery, and other problems start to become common when couples stay together despite serious unresolved issues.

No fault divorces

Florida and almost every other state in the U.S. allows couples to get a no fault divorce. This term comes from the fact that fault based grounds such as adultery, abandonment, incarceration, or mental incapacity used to be required to get a legal divorce. However, today at least one spouse only has to say that they believe the marriage is irretrievably broken and wait a short time to begin the formal divorce process. Most family law attorneys can assist with related matters such as property division and child custody to try to make the process as efficient and painless as possible. Couples in Florida must also have lived in the state for several months before the divorce to meet residency requirements.
